How to promote online gambling in Germany: 3SNET review

From 1 July 2022, Germany’s new gambling regulator Gemeinsame Glücksspielbehörde der Länder (GGL) started actively taking measures against the activities of unlicensed operators and their advertising. First and foremost, the IP addresses of illegal websites will be blocked, as well as the payments made to them.

A specific procedure for blocking will be presented by the regulator on 8 July 2022.

At the beginning of July 2022, the state administration of Saxony-Anhalt, where GGL is based, announced that it had issued 9 more licenses for online slots and, for the first time, for online poker. The first licenses were issued in May, with Gauselmann Mernov, operators Tipwin and Mybet receiving them. In total, according to the regulator, operators have submitted a total of 71 applications for online licenses.

It should be recalled that a year ago – on 1 July 2021 – new legislation came into force in Germany: the Fourth Amendment of the Interstate Treaty on Gambling, opened the market for online casinos, online poker and online sports betting. As part of it, the country has allowed separate nationwide licenses for online slots, online poker and online sports betting. From 1 January 2023, the Glücksspielbehörde is to take over the entire regulation of gambling in the country.

Update from 15 June 2022:

A court in Germany has again ordered a bookmaker to pay a player the money he lost.  The Ludwigslust district court ruled that Betano betting company must pay €4,380 in compensation to a customer who lost €5,380 between 20 February and 4 March 2021. *The amount of compensation is an amount in excess of the national loss limit of €1000 per month. This decision may have industry-wide consequences as other players can now claim their losses above €1000.

As of 1 July 2022, bookmaker Unibet will cease to offer its services to German customers. Withdrawals will be available until the end of 2023.  This is due to the fact that the company was never able to obtain a license to operate in Germany.

Interesting fact! In Frankfurt, a court granted a lawsuit by a player who demanded an online casino to refund his lost money, citing gambling addiction. The player was able to sue the online casino for €12,000. The court argues that the money should be returned because the casino was not registered in Germany but in Malta.

On July 1, 2021, a new gambling law comes into force in Germany. The State Treaty on the Legalization of Gambling (GluNeuRStV) was adopted in March 2020, when the ratification pact was signed by the ministers-presidents of 16 federal states. What will the legalization of the German market do? Expert forecasts

How is gambling regulated in Germany?

The new law will allow licensed online casino operators to offer games across the country, not just in the federal state of Schleswig-Holstein. For an even distribution of rights, duties and responsibilities, the regulation of different industries is assigned to the bodies of different federal states:

  • The basic regulation (the issuance of gambling licenses and control) will be assigned to the office located in the state of Saxony-Anhalt.
  • In Lower Saxony, decisions are being made to block payments for illegal gambling that cross land borders.

All previous licenses of gambling operators will be revoked. To operate in the German market, operators will be required to have a German license with a single nationwide regulatory catalog. German licenses will also be needed for companies with an EU license that previously provided their services in Germany. If the relevant application is not submitted, they will not be able to work in the German market. Online casinos wishing to obtain a German license must stop offering table games (roulette, baccarat, blackjack) and live games. In addition, gambling sites with a German license will no longer be called casinos and will not contain the terms ” Spielbank “or ” Spielhalle”, which are synonymous with the word “casino”.

In May 2021, the Committees of the German Parliament began to consider a draft federal law that establishes the taxation of online gambling. The bill must be passed by deputies before July 2021. The draft law suggests a tax rate of 5.3% of the turnover of gambling operators. This is due to data that was previously provided by the analytical company Goldmedia. The study showed that most players are afraid of reducing their winnings: licensed operators will want to compensate for losses. In this situation, the majority of gamblers — up to 49% – plan to switch to offshore online casinos. The new tax also violates the European norm on fair competition and the prohibition of privileges. The rate for online platforms is 15 times higher than the rate from the revenue of land-based slot machine halls and 5 times higher than for land-based casinos. GVC (owner of the brands bwin, Sportingbet, Ladbrokes, Gamebookers) sent out a letter demanding to remove all banners and advertising text related to casino and poker products, to stop any activity on social networks and applications aimed at German players. Bet365 has also instructed its affiliates to cease advertising activities in Germany, and banned the promotion of other competitors’ gaming offerings when promoting bet365. The restrictions are tough. However, Germany has just embarked on the path of regulation, and the authorities have not yet taken into account all the points. For example, the mechanism for blocking sites that will work without a German license is unclear. Also, it is not specified anywhere what penalties can be applied to violators.
