What are the laws regulating online gambling in Buenos Aires?
- Article 37 of the Constitution (Carta Magna) of the District of Buenos Aires, according to which the local government maintains a monopoly on the operation of casinos and gaming halls.
- Law No. 15.079 “Regulation of Online Gambling” (Ley No. 15.079 – T?tulo VIII – Regulaci?n del Juego online, Section VIII). It specifies all the rules for the organization and regulation of online gambling.
The regulatory authority is the Provincial Institute of Lottery and Casinos of the Province of Buenos Aires/Loteria da la Province. This body initially formed the requirements for Internet platforms. Now they issue licenses to organize games, as well as permits for advertising, sponsorship, and promotion. To obtain an Argentine license to work in Buenos Aires, you need to complete more than 20 points: indicate the availability of past licenses and experience, provide a financial assessment and development plan, indicate measures to create conditions for responsible play, and prevent fraud. It is important that the Buenos Aires regulator has the right to request information from operators about registered participants. Only those who live or are currently in the province can play casino and bet. To obtain an online license, you need to pay 65 million Argentine pesos (about 620 thousand euros) once. The list of companies that received a license to work in Buenos Aires according to July 2021 can be found on the regulator’s website. In 2021, such well-known companies as William Hill, Bet365, 888 Holdings, Betfair, Rivalo have already received licenses.
Gambling advertising rules in Buenos Aires (Argentina)
According to the current laws of Buenos Aires:
- only those gambling establishments that have been licensed are allowed to advertise
- It is forbidden to target any advertising to an audience under the age of 18
- Advertising for casinos in Buenos Aires (Argentina) may not be offensive
- It is forbidden to mislead and deceive through advertising.
Buenos Aires’ legislation on gambling is quite simple and logical. It is likely that other provinces of Argentina, which have decided to allow casinos and betting, will choose a similar solution in the near future.
